ISSUE:

Architectural Review Manual (Manual) easement and courtyard villa rock revisions.



ANALYSIS/INFORMATION:

Due to concerns raised by residents, contractors and certain district boards regarding easement encroachment and the utilization of rock as a replacement for sod, staff is providing alternative language allowing landscaping structures to encroach said easement areas and the use of rock as a replacement for sod in courtyard villas.  These revisions are being provided to all boards for consideration.

 

Prior to the districts taking over the architectural review process, owners were permitted to install landscaping structures (landscape walls, curbing and edging) in easement areas up to two (2) feet from the property lines and rock was an acceptable alternative to sod in courtyard villas throughout and in limited use in patio villas. 

 

Approximately, two (2) years ago, subsequent to the districts having purview over external modification to the home and/or lot, the Manual was revised to prohibit all structures, including landscaping structures, in easement areas and prohibited the use of rock except as an accent material in approved landscaping beds.   These changes occurred due to concerns regarding the storm water management drainage system, lawn maintenance (lawn mower access) and aesthetics. 

 

The Manual revisions are attached which in sum permit owners to install landscaping structures in easement areas up to three (3) feet from the property lines and allow courtyard villas to utilize rock as a sod replacement provided the front yard area includes plant material for aesthetic purposes.
